Terms of Service

These Terms of Service ("Terms") govern your use of the SizeChartKit application ("the App") provided by NerdLabs ("we," "us," or "our"). By installing or using SizeChartKit, you agree to these Terms.

1. Service Description

SizeChartKit is a Shopify application, embedded in the Shopify admin, that lets a merchant create size charts, assign them to products, and show them to shoppers as a size guide on product pages through a theme app block, with an inch/centimeter switch and, on the Pro plan, a fit finder that suggests a size from measurements a shopper enters.

2. Account and Eligibility

• You must have an active Shopify store to use SizeChartKit.
• You must have the authority to grant SizeChartKit access to your Shopify store.
• You are responsible for the size charts you and your staff enter, including their accuracy and completeness.
• You are responsible for the security of your Shopify account and for who on your staff can access the App.

3. Pricing and Billing

• SizeChartKit offers a Free tier, free forever: up to 3 size charts, templates, the size guide pop-up and assignment rules.
• The Micro tier is $3.99/month and adds unlimited size charts and chart images.
• The Pro tier is $9.99/month and adds the fit finder, fit feedback badge, size guide analytics, and country/language chart conditions.
• Paid tiers are billed through Shopify's billing system. A 7-day free trial applies to your first paid subscription.
• You may change or cancel your plan at any time through Shopify.
• We reserve the right to change pricing with 30 days' notice.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code from the App
• Use automated systems to scrape or extract data from the App beyond normal use
• Resell, sublicense, or redistribute access to the App
• Interfere with or disrupt the App's infrastructure

5. Data and Privacy

Your use of SizeChartKit is also governed by our Privacy Policy. By using the App, you consent to the collection and use of data as described therein. SizeChartKit stores no customer (buyer) personal data.

You retain ownership of all your store data and the size charts you enter. We claim no ownership rights over your data.

6. Third-Party Services

SizeChartKit runs on Shopify's platform and APIs. Your use of the App is also subject to the Shopify Terms of Service. We are not responsible for the availability, accuracy, or policies of third-party services.

7. Accuracy of Information

SizeChartKit saves and displays the information you provide. While we strive for reliability:

• Unit conversions are rounded (to 0.5 in or 0.1 cm), and fit-finder suggestions depend entirely on the measurements in your charts.
• How and where the size guide appears on your storefront depends on your theme and store setup.
• You are solely responsible for the content of your product listings and for your return and exchange policies.

8. Limitation of Liability

To the maximum extent permitted by law:

• SizeChartKit is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
• We are not liable for returns, exchanges, lost sales, or other business losses arising from the use of, or reliance on, the App.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify you of planned downtime.

10. Termination

• You may terminate your use at any time by uninstalling the App from your Shopify store.
• We may suspend or terminate your access if you violate these Terms.
• Upon termination, your access tokens are deleted immediately and the data held by the App will be deleted within 30 days per our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance. We will notify you of material changes via the App or email.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation first, then binding arbitration if necessary.
